Terms of Service

Welcome to Safe After Me, operated by Shipsure, Inc. ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our digital vault service for storing and sharing important information with your designated beneficiaries.
By creating an account or using Safe After Me, you agree to these Terms. If you don't agree, please don't use our service.
1. Our Service
Safe After Me provides a secure digital vault where you can store documents and information that you want your next of kin or designated beneficiaries to access when you die or become incapacitated. We use end-to-end encryption to protect your sensitive data, which means we cannot read or access your encrypted documents and certain database information.
2. Eligibility
You may use Safe After Me regardless of age. However, if you are under 18, we encourage you to use this service with the knowledge and involvement of a parent or guardian.
3. Account Creation and Security
Your Account: When you create an account, you're responsible for maintaining the security of your account credentials, including your passkey.
Passkeys: We strongly recommend using passkey authentication rather than email/password. Passkeys provide enhanced security for your account.
Account Recovery: If you lose access to your passkey, recovery is only possible through the vault members you've designated. They can help re-authorize you and restore access to your encryption keys without those keys ever touching our servers. We cannot recover your account for you due to our zero-knowledge encryption architecture.
Account Security: You are responsible for all activities that occur under your account. Notify us immediately if you suspect any unauthorized use.
4. Subscription and Billing
Free Trial: New users receive a 1-month free trial upon signup.
Subscription Fee: After your free trial, Safe After Me costs $80 per year.
Discounts: We may offer promotional discount codes (such as $10 off per year) and referral credits. These discounts apply as long as your subscription remains active and renews.
Payment Processing: Payments are processed through Stripe, a third-party payment processor. You agree to Stripe's terms and conditions.
Automatic Renewal: Your subscription automatically renews each year unless you cancel.
No Refunds: All payments are non-refundable. You may cancel your subscription at any time to prevent future charges.
Cancellation: You can cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period.
5. Referral Program
Referral Credits: We offer a referral program where you can earn $10 per year for each user you refer, as long as their subscription remains active and renews.
Beneficiary Continuity: If you pass away, referral credits can continue to a designated beneficiary you've specified, consistent with our mission of passing value to your inheritors.
Program Terms: We reserve the right to modify the referral program terms at any time, including credit amounts, eligibility requirements, and program structure.
Fraud Prevention: We reserve the right to revoke referral credits if we detect fraudulent activity or abuse of the referral program.
6. Data Storage and Encryption
End-to-End Encryption: Your documents and sensitive data are encrypted end-to-end using zero-knowledge encryption. This means only you and the people you authorize can decrypt and access this information. We cannot access, read, or decrypt your sensitive data.
Storage Infrastructure: We use Google Cloud Storage to store your encrypted data.
Storage Limits: We do not currently impose storage limits on your account, but we reserve the right to implement reasonable limits in the future with advance notice.
Data Retention: We retain your data indefinitely, even if you stop paying your subscription. However, if your subscription lapses, you will not be able to access your account or data until you renew.
Data Deletion: If you want your data permanently deleted, you must submit a written request to us. Upon receiving your written deletion request, we will delete your data promptly. Please note that due to encryption, we cannot verify the contents of encrypted data before deletion.
7. Vault Sharing and Beneficiary Access
Inviting Members: You (the "Owner") can invite other users to your vault and assign them roles such as viewers, admins, or beneficiaries.
Viewer Access: You can share specific sections of your vault with viewers at any time while you're alive and have access to your account.
Beneficiary Access Upon Death or Incapacity: To unlock the full vault for beneficiaries, we require:
- For death: A death certificate, plus admin confirmation
- For incapacity: Both a Durable Power of Attorney and a letter from a doctor confirming incapacity, plus admin confirmation
Changing Beneficiaries: You may change your designated beneficiaries at any time through your account settings.
Ownership Transfer: You may transfer ownership of your account to another user at any time.
No Dispute Resolution: Safe After Me provides access to documentation and information only. We do not distribute assets, mediate disputes between potential beneficiaries, or make determinations about rightful heirs. Any disputes must be resolved outside our service.
8. Prohibited Uses
You may not use Safe After Me to:
- Store, share, or distribute illegal materials
- Store, share, or distribute child sexual abuse material
- Engage in any illegal activities
- Violate any applicable laws or regulations
- Impersonate others or provide false information
- Interfere with or disrupt the service or servers
- Attempt to gain unauthorized access to other users' accounts or data
While we cannot access your encrypted content to monitor compliance with these prohibitions, violation of these terms may result in account termination if we become aware of such violations.
9. Intellectual Property
Safe After Me and its original content, features, and functionality are owned by Shipsure, Inc. and are protected by copyright, trademark, and other intellectual property laws.
You retain all rights to the content you upload to Safe After Me. By uploading content, you grant us a limited license to store, encrypt, and transmit your content solely for the purpose of providing our service to you and your designated beneficiaries.
10. Disclaimer of Warranties
Safe After Me is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The service will be uninterrupted, timely, secure, or error-free
- The results obtained from using the service will be accurate or reliable
- Any errors in the service will be corrected
- The service will meet your specific requirements
You use Safe After Me at your own risk. While we implement strong security measures including end-to-end encryption, no system is completely secure, and we cannot guarantee absolute security of your data.
11. Limitation of Liability
To the maximum extent permitted by law, Shipsure, Inc., its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of Safe After Me.
Our total liability to you for all claims arising out of or related to these Terms or Safe After Me shall not exceed the amount you paid us in the twelve months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.
Important Note on Critical Timing: While we strive for reliability, we cannot guarantee that the service will be available at critical moments (such as immediately following your death or incapacity). We are not liable for any delays, failures, or inability to access data when needed.
12. Indemnification
You agree to indemnify, defend, and hold harmless Shipsure, Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of Safe After Me
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Content you upload to the service
13. Dispute Resolution and Arbitration
Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or Safe After Me shall be resolved by binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.
Arbitration Rules: The arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will take place in Delaware.
No Class Actions: You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or class member in a class, consolidated, or representative action.
Exceptions: Either party may seek injunctive or other equitable relief in court to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
15. Changes to Terms
We may modify these Terms at any time. When we make changes, we will notify you by email on the effective date of the changes. Your continued use of Safe After Me after changes become effective constitutes your acceptance of the revised Terms.
If you don't agree to the modified Terms, you must stop using Safe After Me and may request deletion of your account and data.
16. Service Changes and Availability
We reserve the right to modify, suspend, or discontinue any aspect of Safe After Me at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the service.
17. Termination
By You: You may terminate your account at any time by canceling your subscription or requesting account deletion in writing.
By Us: We may suspend or terminate your account if you violate these Terms or for any other reason, with or without notice.
Effect of Termination: Upon termination, your right to access and use Safe After Me immediately ceases. Your data will be retained indefinitely unless you request deletion in writing, in which case we will promptly delete your data.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
19. Entire Agreement
These Terms constitute the entire agreement between you and Shipsure, Inc. regarding Safe After Me and supersede all prior agreements and understandings.
